Terms of Service

1. Agreement to Terms

By accessing or using Datamapify ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Description of Service

Datamapify is a data mapping and transformation tool that helps you:

  • Upload and process CSV and Excel files in your browser
  • Map columns between different data formats with intelligent suggestions
  • Apply transformations to your data
  • Import from and export to Google Drive
  • Save reusable mapping templates

All data processing occurs locally in your browser. File contents are not uploaded to our servers.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

5. Subscription and Pricing

Free Tier

The free tier allows limited use of the Service, including saving up to 16 mapping templates.

Pro Subscription

The Pro subscription costs $5 USD per month and provides access to additional features including increased template storage and larger file limits.

Automatic Renewal Notice

Your subscription will automatically renew each month at the then-current rate ($5/month) unless you cancel before the renewal date. You will be charged on the same date each month. To avoid being charged, you must cancel at least 24 hours before your renewal date. You can cancel anytime from your account settings or by contacting us.

Billing

  • Subscriptions are billed monthly in advance via Stripe
  • You authorize us to charge your payment method on a recurring basis
  • You may cancel at any time; access continues until the end of your billing period
  • Refunds are provided on a case-by-case basis; contact us within 7 days of a charge if you believe it was made in error
  • We reserve the right to change pricing with 30 days notice; existing subscriptions will continue at the current rate until renewal

How to Cancel

You can cancel your subscription at any time by visiting your account settings or by emailing support@datamapify.ai. Cancellation takes effect at the end of your current billing period.

6. Your Data

You own your data. We do not claim any ownership rights to the data files you process using the Service. Your CSV and Excel files remain yours.

Mapping templates you save are stored on our servers to enable syncing across devices. You can delete your templates at any time.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to interfere with or disrupt the Service
  • Circumvent any rate limits or security measures
  • Share your account credentials with others
  • Use automated systems to access the Service without permission
  • Reverse engineer or attempt to extract source code

8. Third-Party Services

The Service integrates with third-party services including:

  • Google Drive: For importing and exporting files. Subject to Google's Terms of Service.
  • Clerk: For authentication. Subject to Clerk's Terms of Service.
  • Stripe: For payment processing. Subject to Stripe's Terms of Service.

We are not responsible for the availability, accuracy, or content of these third-party services.

9. Intellectual Property

The Service, including its design, features, and code, is owned by Fabrial LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted or error-free
  • Results obtained will be accurate or reliable
  • The Service will meet your specific requirements

You are responsible for verifying the accuracy of any data transformations before using them.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FABRIAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Fabrial LLC from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access if you violate these terms, with or without notice. Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data after a reasonable period
  • Sections 6 (Your Data), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), and 14-19 survive termination

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemic, war, terrorism, riots, power failures, telecommunications failures, or cyberattacks.

15. Changes to Terms

We may update these terms from time to time. We'll notify you of material changes by posting a notice on our website and, where possible, by email. Your continued use of the Service after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you should stop using the Service before they take effect.

16. Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at legal@datamapify.ai.

17. Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations under these terms without restriction, including in connection with a merger, acquisition, or sale of assets.

18. Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Fabrial LLC regarding your use of the Service. These terms supersede any prior agreements or communications.
